Getting Divorced in Southern Maryland: What You Need to Know

Our firm represents spouses in Southern Maryland in contested, uncontested, and military divorces. Read below to learn a little bit about what you can expect during your divorce. Then contact us to arrange your confidential initial divorce consultation.

Contested Divorce

If you and your spouse are at odds, then you may be looking at proceeding with a contested divorce. In a contested divorce, the spouses disagree on one or more issues in the divorce. If you cannot reach an agreement, you will need to rely on a judge to decide the terms of the divorce for you. Each spouse presents his or her case in court, and then the judge issues a binding decision at the end of the proceedings.

Along the way, the spouses will have various opportunities to come to terms. You may even be required to try mediation. You may be able to come to an agreement on some—or possibly all—aspects of your divorce.

During a contested divorce, there are several issues that you must resolve to bring a discordant marriage to an end. These issues include:

  • Division of the spouses’ marital property;
  • Division of the spouses’ marital debts;
  • Calculation of spousal support;
  • Calculation of child support; and
  • Establishment of custody and visitation rights.

Within each of these broad categories, there are numerous discrete issues that must be addressed individually. From determining which assets qualify as marital property to determining what income needs to be considered for purposes of calculating child support, we make sure our clients have a crystal-clear understanding of all the various issues and implications involved in the divorce process.

Uncontested Divorce

If you and your spouse are on good terms, then you may be able to pursue an uncontested divorce to bring your marriage to an amicable close. In an uncontested divorce, the spouses agree on all the various issues discussed above.

To pursue an uncontested divorce, it is not necessary for you and your spouse to be in complete agreement on everything. If you are close to an agreement, you can pursue mediation to help you resolve any remaining issues. Our Southern Maryland divorce lawyers can help you understand when it might make sense to consider these options.

Military Divorce

For members of the military and their spouses, divorce presents certain additional challenges. Many (but not all) of these additional considerations relating to the spouses’ respective rights to military retirement savings and other military benefits. For those who are stationed overseas, divorce can also present unique challenges with regard to child custody.

At Andrews, Bongar, Gormley & Clagett, we proudly serve military servicemen and servicewomen stationed at NAS Patuxent River Navy Base in Lexington Park, Joint Base Andrews in Camp Springs, NSF Indian Head Navy Base, and of course the Pentagon. We also serve other enlistees and officers who live in Southern Maryland and have represented many veterans in the divorce process as well. If it is time to bring your marriage to an end, our Waldorf divorce lawyers can assist in protecting your legal and financial interests to the fullest extent possible.

Take the Next Step Towards a Better Future with Southern Maryland Law

If you need to speak with a family law legal team in Southern Maryland, what are your next steps? You can read our Family Legal Guide for some important tips. Or you can contact us now to schedule an appointment with one of our experienced Southern Maryland divorce attorneys.

At Southern Maryland Law, our Waldorf divorce lawyers offer a flat fee initial consultation for a reason: If you have questions or concerns, we want you to seek help. You should never be deterred from speaking with a lawyer due to financial considerations. We want you to have the information you need to make the right decisions for you.

Too often, people let family-related legal issues linger. They don’t want to deal with the stress, they feel like they don’t have the time, or they assume (or hope) that the issue will eventually go away on its own.

Unfortunately, this passive approach often proves costly. Many issues can become more challenging to resolve if they are not addressed promptly.

During your initial consultation, you will speak with our Waldorf divorce attorney one on one. Everything you say will be held in strict confidence, and you will not be under any obligation to pay for additional advice. If you decide that you would like our help, we will clearly explain our fees so that you will know exactly how much you can expect to pay.

Our experienced legal team also handles other types of family law cases, including:

We serve family members throughout Southern Maryland. We are currently conducting initial consultations by phone and Zoom for individuals who prefer these options. To schedule an appointment, contact us today.

Why Choose Southern Maryland Law?

We are your community law firm

We have been a vibrant part of Waldorf for over 60 years. Waldorf has been very good to us, and we try to repay that kindness with community service. We believe giving back to our Waldorf community is part of our job.

Large enough, yet small enough

We are large enough to provide full service, but small enough to focus on you. The large firms that have satellite offices in Waldorf have dozens of attorneys who don’t live here. They use case managers to handle their clients. At Southern Maryland Law, you will be a name – not a number.

The senior law firm in Waldorf

We are the oldest law firm in Waldorf, and the 2nd oldest in all of Southern Maryland! We have stayed busy because we get results and treat our clients right. We would never have lasted this long if we did not.

Not your grandfather’s law firm

While our firm has been around a long time, we are not what you think lawyers are like. We pride ourselves on being a little more approachable, a little more casual, and a little more likeable than the average lawyer. We are real people with real solutions to your real problems.
