A woman ended up crashing her car into a lake in Waldorf after texting and driving. This happened Tuesday on St. Charles Parkway near St. Thomas Drive. The woman admitted to police that she was texting and driving when the crash occurred. She originally hit a tree, and then went into the lake. Luckily, the lake is only 5 feet deep and she was easily able to get out of her car without injuries.
Thank God she is none the worse for the incident, and that nobody else was injured. This could have been a lot more serious. She is very lucky she did not drown.
I am sure her car will be a total loss, and her insurance will pay for it – less her deductible. She cannot sue anyone for the incident in Maryland. Even if she wanted to claim the road was improperly planned or the fence around the lake should have stopped her, she will be prevented from suing due to contributory negligence. She caused the accident by texting, or at the very least was negligent when texting. Therefore, under Maryland law, she cannot maintain a suit for her injuries under any circumstances.
